Students Living Apart From Guardian

When a student is living within Frisco ISD, apart from their legal guardian, the legal guardian must assign educational rights to the non-guardian with whom the student is living in order for the student to establish residency with the non-guardian in Frisco ISD. The legal guardian and non-guardian being assigned educational rights must complete the following process:

  • The legal guardian must complete and provide to the campus a Power of Attorney Assigning Educational Rights stating that the student is living with a non-guardian in Frisco ISD and that the non-guardian is granted educational rights; and

  • The non-guardian who has been assigned educational rights must provide proof of residency as described above AND a Student Residency Affidavit. The Affidavit must be provided in person to the campus.

Requirements for the Power of Attorney Assigning Educational Rights

Frisco ISD accepts a Power of Attorney Assigning Educational Rights in any form provided that it includes the following:

  • names, addresses, phone numbers, and signatures for all legal guardians;

  • a statement that the guardians have chosen to have the student live with the designated non-guardian;

  • a statement that the guardians assign educational rights to the non-guardians and designate the non-guardian as the primary contact for the school; and

  • either notarized signatures of the guardians OR unnotarized signatures and copies of the guardians’ drivers’ licenses (out-of-state notarization is acceptable for the Power of Attorney Assigning Educational Rights only.) 

Example of acceptable Power of Attorney Assigning Educational Rights:

Our names are John Smith and Jane Smith, and we reside at 123 Main Street, Tulsa, OK, 74100. We are the parents of Jimmy Smith. We have designated Susan Smith, Jimmy’s aunt, as his primary caregiver, and Jimmy is currently living at her residence at 456 Ohio Drive, Frisco, TX 75035. We consent to allowing Susan Smith to make educational decisions for the child and be the primary school contact for the child.

Requirements for Student Residency Affidavit
Frisco ISD only accepts Affidavits Affirming Student Residency using the form provided. After the campus has received a Power of Attorney Assigning Educational Rights, the non-guardian to whom educational rights have been assigned must complete the Student Residency Affidavit and provide the Affidavit in person to the campus. The Affidavit must be notarized which can either be done at the campus, or prior to the form being provided in person.

  • The Affidavit must be completely filled out by the non-guardian to whom educational rights have been assigned. When the non-guardian delivers the Affidavit, the non-guardian will be informed that the non-guardian will now be the primary contact regarding the student.

  • Upon completion of the Affidavit, a campus staff member may ask to visit the home to ensure that the student actually lives there.  

  • Each year, the non-guardian must provide a new Affidavit.

  • If a legal guardian revokes the previously provided Power of Attorney Assigning Educational Rights, then the Student Residency Affidavit becomes void and the legal guardian must enroll the child in the district and zone where the legal guardian lives.
